How do I dispute a 1099-MISC form when the company is no longer in business?

I just received a 2008 1099-MISC form from a previous employer listing over $2000 in the “RENTS” box. I never received any such payment(s) as I simply worked in an office leased by my former company. I want to dispute this form, but the company has since gone out of business. Their phone has been disconnected and their corporate address is no longer valid. How do I go about correcting this issue?

    “Correcting”? I have a feeling that the information is right, and that you received “imputed rents” worth $2,000.

  2. If you just received this, SOMEONE is handling the winding up of the business records. Contact them at the address they show on the 1099 and contest the issue. Demand proof. Employers cannot report payments to employees on Form 1099 — they go on Form W-2 either as taxable wages or in box 12.

    If you get no response from them, contact the IRS. Copies of the W-2 from 2008 will probably be sufficient to prove to the IRS that you don’t have any income reportable on Form 1099.

    I have no clue what the other poster is referring to with “imputed” rents. Employees don’t receive rental income from their employer.

    There should be an address on the 1099. Try that one. Also when someone gives you a 1099 they are supposed to have proof that they paid you that amount like canceled checks so before you contest check all your previous checks that they wrote you just to be sure.
